2. The petitioner apprehends his arrest for the offences alleged under Sections 413 and 414/34 of the Indian Penal Code, registered in connection with Kanhauli P.S.Case No. 08 of 2023.

3. As per the allegation, the petitioner along with others, was involved in selling of stolen motor-cycles.

4. The learned counsel for the petitioner has submitted that nothing was recovered from his possession and his name has figured only in the confessional statement of coaccused Sikandar Paswan.

5. Considering the above facts and circumstances, let

No.54043 of 2023(3) dt.08-11-2023 2/2 the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sitamarhi in connection with Kanhauli P.S.Case No. 08 of 2023, subject to the conditions as laid down under Section 438(2) Cr. P.C. with further condition as under:- i. The petitioner shall cooperate in the disposal of trial and make himself available on each and every date fixed at the trial till framing of charge and if he fails to appear on two consecutive dates without any reason or unavoidable circumstances, the court below shall cancel his bail bond.

ii. If it is found that the petitioner is involved in any other case, his bail bond shall be cancelled.
