The petitioner seeks bail in Chainpur P.S. Case No. 182 of 2015 dated 14.09.2015 instituted under Section 366A of the Indian Penal Code.

The allegation against the petitioner is of abducting the minor daughter of the informant.

Learned counsel for the petitioner submits that this is a case of love affairs as the girl, who is not a minor, had gone with the petitioner on her own free will. For such proposition, learned counsel

Patna High Court Cr.Misc. No.25296 of 2016 dt.15-06-2016 2/2 refers to the statement of the daughter of the informant, that is, the socalled victim girl, upon recovery, under Section 164 of the Code of Criminal Procedure, 1973, copy of which has been made Annexure-2 to the application. It is submitted that the petitioner has clean antecedent and is in custody since 07.04.2016. Learned A.P.P. submits that there is allegation of abduction against the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Kaimur at Bhabua in Chainpur P.S.
