Petitioner apprehends arrest in a case registered for the offence punishable under Sections 406, 323, 504 of the IPC. As per the prosecution case, the informant deposited Rs. 90,000/- in the account of the petitioner for purchase of a piece of land, but after receiving the said amount, the petitioner refused to execute the sale-deed in favour of the informant nor refunded the alleged amount.
It is submitted on behalf of the petitioner that petitioner has been falsely implicated in this case. He is registered contractor in the Department of P.W.D and the dispute arose out of money transaction between the parties and as such no offence is made out against this petitioner. The dispute is

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Dhananjay Panday 1st class Judicial Magistrate, Banka in connection with Complaint Case NO. 1044 of 2018 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
