JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report, which has been lodged on the basis of fardbeyan of injured witness/informant, who claimed that two F.I.R named accused took him as well as his brother and, after that, they were badly assaulted by the aforesaid two F.I.R named accused, as a result whereof his brother died, whose dead body was thrown in river by the aforesaid two F.I.R named accused.
In course of investigation, the further statement of injured witness/ informant was recorded and in that statement, he claimed about the participation of the petitioner in the present crime.
Patna High Court Cr.Misc. No.25851 of 2016 (2) dt.24-06-2016 2/2 Learned counsel for the petitioner points out that the above stated further statement of the injured witness/informant, was recorded after 8 to 9 days of the alleged occurrence and, as a matter of fact, the name of petitioner was taken by the injured witness/informant due to village politics and enmity. Taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kharagpur P.S.Case No. 143 of 2015.
