2. The petitioner seeks bail in connection with Sigori P.S. Case No. 118 of 2024 registered for the offence under Sections 115(2), 117(2), 118(2), 109(i), 352, 3(5), 103, 3(5) of the BNS alongwith Section 27 of Arms Act.
3. The petitioner is not named in the F.I.R. and is in custody since 12.11.2024.
4. As per FIR, unknown miscreants opened indiscriminate firing upon the husband of the informant leading his death in AIIMS Hospital, while receiving his treatment.
5. Learned counsel appearing on behalf of the petitioner submitted that the name of this petitioner
Patna High Court CR. MISC. No.50431 of 2025(2) dt.11-09-2025 2/3 transpired during the course of investigation out of confessional statement of co-accused namely, Afroz Alam. It is submitted that the said co-accused Afroz Alam recorded his statement before police four times but initially he failed to name this petitioner but subsequently as an afterthought he named this petitioner, in furtherance of which no incriminating material appears recovered/ surfaced as to connect petitioner prima-facie with present crime in question. It is submitted that petitioner was not put on TIP as yet, having all occasion as the occurrence was witnessed by one Md. Afroj Alam of Sigori village.
In this context, it is also submitted that similarly situated co-accused, namely, Faijal @ Kittu @ Faijal Niyaji has alredy granted bail by learned Coordinate Bench of this Court through Cr. Misc. 36685 of 2025 dated 06.08.2025. It is pointed out that charge in this matter has already framed on 22.07.2025 and therefore, on the ground of parity this petitioner also deserves bail.
Patna High Court CR. MISC. No.50431 of 2025(2) dt.11-09-2025 3/3 charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP opposed the prayer of bail.

In view of aforesaid factual submissions as save and except suspicion arising out of confessional statement of co-accused prima-facie no incriminating material appears recovered/ surfaced during investigation as to connect petitioner with present crime in question, coupled with fact that investigation of this case already completed, where petitioner remains in custody since 12.11.2024, accordingly petitioner above named, is directed to be released on bail in connection with Sigori P.S. Case No. 118 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge VI, Danapur /concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
