====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-08-2018 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Bihariganj P.S. Case No. 33 of 2018 registered for the offence punishable under sections 323, 341, 307, 120B, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Section 302 of I.P.C. was added later on.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. There is no specific allegation against petitioner rather specific allegation is against co-accused Abhay Kumar Yadav. Moreover, similarly situated co-accused has been granted bail by a co-ordinate Bench of this Hon'ble Court vide order dated 11.07.2018 passed in Cr. Misc. No. 39793 of 2018. Petitioner has no criminal antecedent and is in custody since 19.06.2018.

No.50160 of 2018(2) dt.14-08-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Class Judicial Magistrate, Uda-Kishunganj (Madhepura) in connection with Bihariganj P.S. Case No. 33 of 2018.
