JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 201 and 34 of the Indian Penal Code. Allegation is that petitioner along with two other coaccused was enjoying Holi with son of the informant but informant's son did not return till late night. On next day his dead body was found in the Canal.

It has been submitted on behalf of the petitioner that he is in custody since 20.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. It is a case of last seen. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest implication of the petitioner in the present case. Other co-accused has been granted bail vide Annexure-2 to the present application. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.26216 of 2016 (3) dt.18-08-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj P.S. Case no. 126 of 2013.
