====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 20-12-2021 Heard learned counsel for the parties.

The petitioners apprehend their arrest in connection with Bhagwanbazar P.S. Case No. 562 of 2019 registered for the offence under Sections 406, 420, 120B of the Indian Penal Code. Considering the submissions of the learned counsel for the petitioners, the Court wanted the petitioners to return the money to the opposite party no.2, but the petitioner is trying to justify his action by producing some documents.

In these days, it is very common that money is being taken from parents for getting their wards admitted in Medical Colleges and thereafter accused somehow tried to justify their action for use of aforesaid money taken by them.

Considering the aforesaid, this application for anticipatory bail is dismissed.

If, they do not surrender before the Court below, then the Superintendent of Police, Saran at Chapra shall take all coercive steps to arrest the petitioners and inform this Court about their arrest. Put up this case on 12th of January, 2020 for compliance and further direction.

Let a copy of this order be communicated to the Superintendent of Police, Saran at Chapra for its compliance through Fax/e.mail.

Mr. Jharkahndi Upadhyay, learned A.P.P. is also directed to communicate this order to the Superintendent of Police, Saran at Chapra through Telephone.
