JUSTICE SUDHIR SINGH ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 399, 402, 386 and 414/34 of the Indian Penal Code. Allegation against the petitioner is that in course of raid at Dilli More by police he was apprehended with a mobile phone and petitioner failed to produce any document in respect to the mobile. Petitioner stated that he had come there to commit crime. It has been submitted on behalf of the petitioner that he is in custody since 26.2.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner.
Petitioner had no knowledge that the motorcycle in question was a stolen property, He denied the recovery of the said motorcycle from his possession. There is no compliance of Section 100 of the Code of Criminal Procedure. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
Patna High Court Cr.Misc. No.26326 of 2016 (3) dt.23-08-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with University P.S. Case no. 50 of 2016.
