2. The petitioner in the present case is seeking the following reliefs:- "(i) For commanding the respondents to Upgrade the Middle School Kamatpur, Shambhuganj, Banka as High School and start education in Class IX as per the Government Policy.

(ii) For commanding the respondents to grant any other relief/reliefs for which the petitioners are otherwise found entitled for."

3. Learned counsel for the petitioner submits that the

Patna High Court CWJC No.11632 of 2023(2) dt.25-09-2023 2/2 petitioner has filed a representation before the various authorities for redressal of his grievances but the same are not being considered. In this regard, attention of this Court has been drawn towards the representation enclosed as Annexure 'P/9 (series)' to the writ application. A prayer has been made to direct the Director (Secondary Education), Government of Bihar to consider the representation as contained in Annexure 'P/9 (series)' and take an appropriate decision thereon in accordance with law.

Learned counsel for the State has no objection in disposal of the present writ application with a direction to the Director (Secondary Education), Department of Education, Government of Bihar, Patna (respondent no. 6) to consider the representation of the petitioner and take an appropriate decision thereon.

5. Having regard to the kind of disputes and submissions noted hereinabove, this Court deems it just and proper to direct respondent no. 6 to consider the representation of the petitioner as contained in Annexure 'P/9 (series)', hear the parties and take appropriate decision in the best interest of the school and the students of the locality. Such decision shall be taken within a period of three months from the date of receipt/communication of a copy of this order.
