JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-10-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek regular bail in connection with Marhaura P.S.Case No. 333 of 2016, registered for offences punishable under Sections 304 (B)/34 of the Indian Penal Code. Allegation as per F.I.R against the petitioners, who happens to be the father-in-law and mother-in-law of the deceased, is of killing the deceased due to non fulfillment of demand of Bolero vehicle.

Submission of the learned counsel for the petitioners is that the petitioners have falsely been implicated in this case and during the course of investigation all the petitioners were found to be innocent and husband of the deceased has already been granted anticipatory bail by this Court, which appears from impugned

Patna High Court Cr.Misc. No.52246 of 2018 (2) dt.04-10-2018 2/2 order and petitioners are other than husband, and are in custody since 25.04.2018.

Heard learned A.P.P. as well as learned counsel for the informant submits that husband of the deceased was not residing there and death was due to strangulation. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- XIII, Saran at Chapra in connection with Marhaura P. S. Case No. 333 of 2016, subject to the following conditions:- i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

ii) The petitioners will not induce any witness or tamper with the evidence.
