The petitioners are apprehending their arrest in connection with Danapur Police Station Case No.599 of 2014 for allegedly having committed the offence under Sections 341/342/323/448/354/379/307/34 of the Indian Penal Code and Section 3(i) X of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Learned counsel for the petitioners submits that the present case has been lodged with a oblique motive and under the provisions of Section 3(i) X of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 has also been invoked to make the charges graver. Learned counsel further submits that as per the statement of the informant, the
Patna High Court Cr.Misc. No.20292 of 2015 (2) dt.23-07-2015 2/2 occurrence took place inside her house, where accused Lakashman Rai is alleged to have assaulted.
Considering the fact that the said occurrence has not taken place in public view and inside the house and there are also no independent witnesses, let the above-named petitioners, in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, in connection with Danapur Police Station Case No.599 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
