Petitioner seeks bail in Bhalravshthan P.S.Case No. 98 of 2020 registered for the offences punishable under Sections 392 and 411 of the Indian Penal Code.

As per prosecution case, the informant was going to Darbhanga, three to four miscreants boarded on a Maruti Car stopped his motorcycle, snatched his motorcycle and mobile and also assaulted him by fists and slaps.

Learned counsel for the petitioner submits that name of this petitioner transpired during course of investigation. It is also submits that no recovery has been made from possession of

Patna High Court CR. MISC. No.61687 of 2021(2) dt.15-02-2022 2/2 the petitioner and up till now petitioner has not put on TIP. He is in custody since 10.12.2020.

Learned APP of the State opposes the prayer for bail of the petitioner and submitted that looted motorcycle was recovered in Laukahi P.S.Case No. 140 of 2020 from possession of the petitioner and petitioner has been remanded in the aforesaid case.

Considering the aforesaid facts and circumstaces, I am not inclined to enlarge the petitioner on bail and hence, his prayer for bail in connection with Bhairavshthan P.S.Case No. 98 of 2020, pending in the court of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani stands rejected.
