In this case, the petitioner is seeking bail in connection with Sessions Trial No. 70 of 2016 arising out of Sikty P.S. Case No. 108 of 2015 registered for offences under sections 302/34 of the Indian Penal Code.
There is a specific allegation against the petitioner which shows that the petitioner has stabbed in the belly of the victim as a result of which he died. In the order of the Sessions Court, where the Case Diary was examined, it has been recorded in a specific manner that the petitioner was allegedly found involved in the commission of offence.
Looking to the entire facts and circumstances of this case, this Court is not inclined to grant bail to the petitioner.
Patna High Court Cr.Misc. No.26956 of 2016 (3) dt.14-07-2016 Accordingly, the prayer for regular bail of the petitioner, namely, Abul Kalam @ Abul Klam is rejected. The court below is directed to expedite the trial of the petitioner and complete the same within a period of one year from today.
