Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376/544 and 324 of the Indian Penal Code.
It is alleged that the petitioner entered into the roof of the informant at 1.00 A.M. in the night and forcibly tried to commit rape and when the informant raised alarm then villagers came there then the petitioner fled away. It is submitted by the learned counsel for the petitioner that no injury report has been brought on record and due to the land dispute the accusation has been levelled. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Let the learned court below consider the prayer for
Patna High Court Cr.Misc. No.9467 of 2015 (2) dt.20-04-2015 regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Jhajha P.S. Case No. 140 of 2014, pending in the court of learned Judicial Magistrate, Ist Class, Jamui. With this observation this application is disposed of.
