The petitioner seeks bail in Kochadhaman P.S. Case No.22 of 2018, registered under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.

The son of the informant was running a mobile shop in the house of the petitioner but when the son of the informant did not return, the informant inquired and came to know that his son had gone with the petitioner, Surendra Prasad Singh. The informant went to the house of the petitioner but the house of the petitioner was found locked. Ravi Kumar and Ram Babu disclosed that two dead bodies were lying in the house of the petitioner. On unlocking the door of the house, two dead bodies, one of the son of the informant and another, the wife of the petitioner were found. Patna High Court CR. MISC. No.48749 of 2019(4) dt.20-11-2019 2/2 relation of his wife with the son of the informant killed the son of the informant along with his own wife inside the house and fled away.

Learned counsel for the petitioner submits that there is no eye witnesses of the occurrence. The petitioner is in jail since 15.02.2018 but it appears that two dead bodies, one of the son of the informant and another, wife of the petitioner were found inside the house of the petitioner and both were brutally killed and petitioner fled away from the house. A report has also been received that out of 12 witnesses, 10 witnesses have already been examined. Only doctor and Investigating Officer are to be examined. The trial is at its fag end.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

The trial court is directed to conclude the trial expeditiously.
