Petitioner No. 1 being husband of the victim and petitioner Nos. 2 and 3 being parents of the petitioner No. 1 are apprehending their arrest in a case registered for the offences punishable under Sections 302, 201/34 of the I.P.C. The basic accusation is killing the daughter of the informant after ten years of marriage by putting her on fire and disposing of the dead body.

It is submitted by learned counsel for the petitioners that accusation is omnibus and general and during investigation the witnesses have suggested that the victim committed suicide.

Considering the nature of accusation, this

Patna High Court Cr.Misc. No.9511 of 2015 (2) dt.20-04-2015 2/2 Court is not inclined to grant bail to petitioner No. 1 namely Prabhunath Gupta.

Let learned Court below consider prayer for regular bail of the petitioner No. 1, if the petitioner No. 1 surrenders within a period of six weeks and pray for regular bail in connection with Bhorey P.S. Case No. 190 of 2014, pending in the Court of learned Chief Judicial Magistrate, Gopalganj.

Accordingly the application with regard to petitioner No. 1 stands disposed off.

Considering the accusation being omnibus and general against petitioner Nos. 2 and 3 and as per own admission of the informant that the victim died after ten years of marriage, let the petitioner Nos. 2 and 3, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Bhorey P.S. Case No. 190 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
