Having regard to the nature of allegation for offence under section 7 of the E.C.Act and that there is some sort of element of credibility in accusation made against the petitioner, inasmuch as the person concerned has produced a receipt of purchase of fertilizer from the shop of the petitioner and that the petitioner was not even authorized to sell such fertilizer to the aforesaid person, this Court is not inclined to grant privilege of anticipatory bail to the petitioner simply on the ground that the said receipt produced by the person concerned was forged. These are the matters of details which can be gone into once the petitioner surrenders, whereafter the court below will examine both the receipts and take a decision for grant of regular bail.
