Mr.Prem Kumar Jha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 21-04-2022 Heard the learned counsel for the petitioners and learned counsel for the Informant as well as learned the A.P.P. for the State.

The petitioners are the accused in connection with Chautham P.S. Case No. 180 of 2021 under Sections 147, 148, 149, 341, 323, 447, 324, 307, 504, 506 of the Indian Penal Code.

The petitioners herein are brother-in-law (Bhaisur) and sister-in-law (Gotini) of the informant. Allegation against the petitioner no.1 is that he gave a knife blow to the informant as also iron rod blow to his son. So far as petitioner no.2 is concerned, no role has been attributed to her. Learned counsel for the petitioners have annexed the injury report of both the informant and Sanjeet Kumar and the

Patna High Court CR. MISC. No.61501 of 2021(2) dt.21-04-2022 2/2 same shows to be simple in nature (as stated in paragraph 18 of the bail application). The petitioners are in jail since 21.08.2021. Taking into account the aforesaid facts as also that the charge sheet has already been submitted, this Court is inclined to grant the privilege of bail of both the petitioners. Let the petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Khagaria in connection with Chautham P.S. Case No. 180 of 2021, subject to the following conditions :- (i) they shall appear before the learned Trial Court on each and every date and failure to do so for two consecutive dates will lead to cancellation of their bail by the Trial Court itself;

(ii) if they indulges in any criminal offence once again, the State shall be at liberty to take steps for cancellation of the bail bond.

With the aforesaid observations, this bail application is allowed.
