JUSTICE SUDHIR SINGH ORAL ORDER 26-08-2016 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The Opposite Party No.2 was impleaded in the present case vide order dated 12.07.2016 and the notice was issued upon him. The counsel for the Opposite Party No.2 has entered his appearance. The petitioner was granted provisional bail by order dated 12.07.2016 on the submission that he has agreed to return the disputed amount of Rs.1,30,000/- to the Opposite Party No.2. It has been submitted on behalf of the petitioner that the petitioner shall return the said amount within a period of six months on equal instalments from the date of receipt/production of a copy of this order.

No.26452 of 2016 (3) dt.26-08-2016 2/2 Considering the aforesaid facts and circumstances, the provisional bail granted to the petitioner, by order dated 12.07.2016 in connection with Nawada (Town) P.S. cacse No.363 of 2015 pending in the court of Chief Judicial Magistrate, Nawada, is extended for further six months from the date of receipt/production of a copy of this order. Once the entire amount has been deposited by the petitioner, the provisional bail granted to the petitioner shall be confirmed by the court below itself. The parties will be at liberty to file a compromise petition in the court below after the settlement of the disputed amount. The court below will be at liberty to consider the said application and pass necessary orders in accordance with law.
With the aforesaid observations, the present application is disposed of.
