Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414, 120B/34 of the Indian Penal Code and Sections 25(1-b)a/25(1-aa)/26/35 of the Arms Act.
Petitioner is in custody since 12.02.2019. Allegation is that on suspicion that the petitioner and others were preparing to commit dacoity some of the co-accused were apprehended and from possession of the petitioner, a country made loaded pistol was recovered. Recovery of firearm and cartridges is from other co-accused also. Petitioner has stated on oath that he has got no criminal antecedent. Investigation of the case against the petitioner is already complete.
Considering the entire facts as well as grant of bail to
Patna High Court CR. MISC. No.49403 of 2019(2) dt.09-08-2019 2/2 some other co-accused by some other Coordinate Benches of this Court, let the petitioner, above named, be released on bail after framing of the charges against the petitioner on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Motipur Police Station Case No. 65 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
