The petitioner has renewed his prayer for grant of bail in a case registered under sections 25(1-B)(a) and 26 of the Arms Act and sections 16, 18, 18A, 18B and 20 of the U.A.P.A. Act. The earlier application for bail of the petitioner was rejected vide order dated 28.2.2022 passed in Cr. Misc. no. 45395 of 2021.

As per the prosecution case, on a raid being conducted three accused persons were caught while others managed to escape. From possession of the petitioner a short stengun besides other articles were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is in custody since 31.12.2020 and there is no

Patna High Court CR. MISC. No.52108 of 2022(3) dt.09-11-2022 2/2 chance of the trial concluding in the near future. He undertakes to cooperate in the trial .

A report was called from the learned trial Court. As per the report received, not a single witness has been examined on behalf of the prosecution in the learned trial Court inspite of summons, bailable warrants and non bailable warrants having been issued for production of the witnesses.

Having heard learned counsel for the parties and taking into consideration the contents of the report of the trial Court and the petitioner having remained in custody since 31.12.2020, the petitioner is directed to be enlarged on bail in connection with S.Tr. No.204/21/305/21 (arising out of Rafiganj P.S. Case no. 316 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-X, Aurangabad.
