The petitioner seeks bail in a case instituted under Section 366(A)/34 of the Indian Penal Code.

The allegation against the petitioner is that he along with the other co-accused has kidnapped the daughter of the informant for the purpose of selling, while the victim had gone to the college.

A report was called for from the trial court. It has been reported that out of four prosecution witnesses, two witnesses have already been examined and the trial is expected to be concluded within a period of 4 months.

Patna High Court Cr.Misc. No.26817 of 2016 (5) dt.09-12-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.11.2015. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The alleged victim is said to have eloped with co-accused Vishal Kumar. The petitioner has got no concern with the said Vishal Kumar.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R. and the victim girl is still traceless. The trial of the case is at a concluding stage. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Sessions Trial No. 234 of 2016, arising out of Town P.S. Case No. 847 of 2015, pending in the court of learned Additional Sessions Judge-III, Muzaffarpur.
