The petitioner, in the present case, is seeking regular bail in connection with Kanti P.S. Case No. 272 of 2018, registered for offences alleged under Sections 413 and 414/34 of the Indian Penal Code.
The allegation against the petitioner is that he was one of the persons riding the motorcycle when it was intercepted and found that the petitioner was no having any document of ownership of the vehicle in question. The allegation is that the vehicle was a stolen vehicle, however, it was handed over by one Juman Miya @ Kankatwa of Sarmaspur Kanti to the petitioner for sale of the vehicle.
Patna High Court Cr.Misc. No.51768 of 2018 (2) dt.20-09-2018 Learned counsel for the petitioner submits that the petitioner is in custody since 24.05.2018, he has no criminal antecedent and now even charge-sheet has already submitted against him.
In the given facts and circumstances wherein the allegation is that the petitioner was handed over the vehicle by one Juman Miya and there is no allegation of commission of theft against him as also that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. (West) Muzaffarpur in connection with Kanti P.S. Case No. 272 of 2018, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
