JUSTICE SUDHIR SINGH ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the I.P.C. and Section 27 of the Arms Act.

The prosecution story, in brief, is that on the alleged date and time of occurrence It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.3.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. In the re-statement in paragraph 6 of the case diary the informant has not named the petitioner. Subsequently his second re-statement was recorded in

Patna High Court Cr.Misc. No.29378 of 2016 (3) dt.05-09-2016 2/2 paragraph 37 of the case diary, where he has raised suspicion against the petitioner. There is no eye witness to the alleged occurrence nor any circumstantial evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Dipak Kumar, Judicial Magistrate, 1st class, Barh in connection with Bhadaur P.S. case No.12 of 2016.
