Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406 and 420 of Indian Penal Code.
As per prosecution case, allegation against this petitioner is that he has not deposited the VAT charge on the materials supplied to informant.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. From the perusal of the F.I.R. it is apparent that occurrence took place in the year 2013-14 and present F.I.R. has been lodged after delay of 4 years. It is further submitted that petitioner had supplied all the materials for which the advance
Patna High Court CR. MISC. No.51337 of 2022(2) dt.19-12-2022 2/2 payment was made by the informant and work has been done in Panchayat with these materials under the MGNREGA Scheme. Business enterprises of the petitioner were duly registered with the tax authority and he has always paid the taxes. Petitioner has got clean antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran in Sonpur P. S. Case No. 587 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
