The petitioner seeks bail in a case registered under Sections 25(1-B)a/26/35 of the Arms Act.
Allegation is that one country made pistol along with one live cartridge is recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.12.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. There is no recovery of arms from the possession of the petitioner. The name of the petitioner has come on disclosure made by co-accused. Petitioner has falsely been implicated in the present case. One
Patna High Court CR. MISC. No.51040 of 2019(2) dt.17-08-2019 2/2 country made pistol along with one live cartridge is said to have been recovered from co-accused. There is no compliance of Section 100 of Cr.P.C.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 14, Motihari, East Champaran in connection with Sangrampur P.S. case No.189 of 2018.
