18-06-2015 Heard Sri Basant Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Amnour P.S. Case No. 08 of 2015 registered for the offence under Sections 272, 273 of the Indian Penal Code and section 47(A) of the Excise Act, has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. He submits that the allegation of recovery of 32 liters countrymade liquor from the petitioner's hutment is completely false, since it was not petitioner's hutment.

Be that as it may and keeping in view the nature of accusation and recovery of country-made liquor, the Court is of

Patna High Court Cr.Misc. No.20642 of 2015 (2) dt.18-06-2015 2/2 the opinion that it is a fit case for extending the privilege of anticipatory bail.

Accordingly, let the petitioner namely Rampal Rai @ Rampal Kumar be enlarged on bail in the event of his arrest or surrender before the court below within a period of one month from today on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Chapra/concerned court in connection with Amnour P.S. Case No. 08 of 2015, subject to condition laid down under Section 438(2) of the Cr.P.C.
