Heard learned counsel for the petitioner and learned counsel for the State.
In this case, the petitioner is seeking bail in connection with S.T. No. 254 of 2016 arising out of Ballia P.S. Case No. 342 of 2015 for offence under Sections 353, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation, the police received information that the accused persons have created a reign of terror at the bus stand. On the tips, the police proceeded there but, by the time, the accused persons fled away. On information, the police reached
Patna High Court Cr.Misc. No.27070 of 2016 (2) dt.12-07-2016 near the banyan tree where four accused persons were found and they started exchanging fire. One person fled away and three persons including the petitioner were apprehended at the spot. Learned counsel for the petitioner in paragraph no. 19 has stated that the petitioner is aged about 68 years. The petitioner is in jail since 29.9.2015.
Looking to the facts and circumstances of the case, let the petitioner, namely, Dayanand Yadav, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-IV, Begusarai in connection with S.T. No. 254 of 2016 arising out of Ballia P.S. Case No. 342 of 2015 subject to the verification of the age of the petitioner as stated in paragraph no.19 of this bail application.
