====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 09-08-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B) and 26 of the Arms Act.

A criminal case was lodged against the petitioner alleging therein that he was abusing and assaulting to the named persons and was having in possession of firearm. During investigation of that case, the police had gone to arrest the petitioner from his house. Petitioner was arrested and firearm along with cartridges were recovered. For recovery of firearm, the present case has been separately registered. Petitioner is in custody since 14.04.2019.

Considering the facts of this case aforesaid as well as

Patna High Court CR. MISC. No.49385 of 2019(2) dt.09-08-2019 2/2 a criminal antecedent of identical nature of the year 2013, let the petitioner, above named, be released on bail after framing of the charges against the petitioner on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Shikarpur Police Station Case No. 159 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
