JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Although the petitioners are named in the First Information Report but according to prosecution case itself, it was co-accused Arbind Singh, who opened fire on the deceased and as far as these petitioners are concerned, it is simply stated that they were also present on the place of occurrence, at the relevant time. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten
Patna High Court Cr.Misc. No.26098 of 2016 (2) dt.05-07-2016 2/2 Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hazipur in connection with Raghopur P.S. Case No. 34 of 2016 corresponding to G.R. No. 1472 of 2016.
