The petitioner is accused in connection with Muffassil P.S. Case No. 181 of 2019, registered under Sections 420, 467, 468 and 471/34 of the Indian Penal Code. The accusation is that in course of patrolling duty, four persons were seen in suspicion condition entering in ATM machine. On seeing the police party, they started to flee away but on chased, three persons were apprehended, who disclosed their names as Ravi Shankar Kumar (petitioner), Md. Shahid Khan and Binod Yadav and they also disclosed the name of their associates Sanjay Yadav, who succeeded to flee away. On search, petitioner was found in possession of four ATM cards of

Patna High Court CR. MISC. No.48241 of 2019(6) dt.22-01-2020 2/2 Punjab National Bank and one scanner device was also recovered from the spot. On search of bag of the petitioner, one laptop was also recovered.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case mere on suspicion and in the present case, petitioner is in custody since 08.05.2019. It is further submitted that similarly situated co-accused, Md. Shahid Khan, who was apprehended with the petitioner, has already been granted privilege of bail by a Bench of this Court vide order dated 05.08.2019 passed in Criminal Misc. No. 47264 of 2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Muffassil P.S. Case No. 181 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
