JUSTICE SUDHIR SINGH ORAL ORDER 10-08-2016 This is the second attempt for bail on behalf of the petitioner. Earlier bail of the petitioner was rejected vide order dated 09.06.2015 in Cr.Misc. No.16116 of 2015 with an observation that if the trial is not concluded within a period of one year from the date of receipt/production of a copy of the order, the petitioner shall be at liberty to renew his prayer for bail. In the light of observation made in the earlier order, the present application has been preferred on behalf of the petitioner. It is submitted on behalf of the petitioner that the petitioner is in custody since 06.02.2015.It has been alleged that the petitioner had fired upon one Dhananajay Kumar but that did not hit him. There is no allegation against the petitioner for causing injury upon the deceased. A report was called for from
Patna High Court Cr.Misc. No.27246 of 2016 (3) dt.10-08-2016 the trial court regarding stage of the case. It has been reported that the charges have been framed. There is no allegation against the petitioner for tampering the witnesses.
On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri B.M. Tripathi, learned Judicial Magistrate,1st Class, Jehanabad in Karpi P.S.Case No. 213 of 2014.
