Petitioner seeks bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The petitioner is brother of the husband of the deceased. Another brother has been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 25.06.2018 passed in Cr. Misc. No. 24419 of 2018.

Submission is that husband is already in custody. The petitioner is separate from the husband of the deceased since long vide a copy of the mutual partition at Annexure-3. Learned counsel for the informant opposed the

Patna High Court Cr.Misc. No.50705 of 2018 (2) dt.23-08-2018 2/2 prayer for bail.

Considering the aforesaid facts, especially, grant of anticipatory bail to the similarly situated co-accused by a Coordinate Bench of this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nadi Police Station Case No. 97 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
