The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 15.12.2015 passed in Cr. Misc. No. 50558 of 2015, on the ground that the petitioner is in custody since 22.06.2015 and trial has not been concluded as yet, to which the learned A.P.P. duly assisted by learned counsel for the informant opposes the prayer of bail by submitting that now only I.O. has to be examined and the learned trial court has reported that within three months the trial will be concluded. In the facts and circumstances stated above, considering that the petitioner is the assailant and trial is likely to be concluded within three months and as such at this stage, I am
Patna High Court Cr.Misc. No.27317 of 2016 (3) dt.24-08-2016 2/2 not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected.
However, the learned trial court is directed to conclude the trial as per submission made in his letter dated 05.08.2016 in connection with Sessions Trial No. 280 of 2015 arising out of Bhabha (Sonhan) P.S. Case No. 249 of 2015 pending in the court of learned Additional District Judge -II, Kaimur at Bhabha.
