The petitioners seek bail in connection with Bodhgaya P.S. Case No. 306 of 2025 instituted for the offences under Sections 191(3), 190, 124(2), 115(2), 121(1), 132, 109, 352 of the Bhartiya Nyaya Sanhita, 2023 and Section 37 of the Bihar Prohibition and Excise Act.

As per prosecution case, the accusation against the accused persons including the petitioners is of assaulting the

Patna High Court CR. MISC. No.52030 of 2025(2) dt.07-08-2025 2/3 police personnel by deadly weapons due to which the police sustained head injuries. It is also alleged that the petitioners along with other co-accused persons also caused hindrance in discharge of official duty under drunken condition. 4.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence as alleged against them and have falsely been implicated in the present case due to suspicion. There is no specific or direct allegation of any overt act against the petitioners rather the same is general and omnibus in nature. The petitioners were only the member of the Barat party. The petitioners have no criminal antecedent and are languishing in judicial custody since 30.05.2025 without any rhymes or reason. Other co-accused has been granted bail by this Court vide order dated 04-08-2025, passed in Cr. Misc. No. 44500 of 2025.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners, stating that the offence alleged is serious in nature. 6.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioners, let the petitioners, abovenamed, be released on bail on

Patna High Court CR. MISC. No.52030 of 2025(2) dt.07-08-2025 3/3 furnishing bail bonds of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bodhgaya P.S. Case No. 306 of 2025, subject to the following conditions; (i) One of the bailor(s) shall be the own/close family members of the petitioners.

(ii) The petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, their bail bond shall be liable to be cancelled by the court below.
