JUSTICE PURNENDU SINGH ORAL ORDER 24-04-2023 Heard Mr. Sanjiv Kumar Singh, learned counsel appearing on behalf of the petitioner, Mr. Tarkeshwar Prasad Verma, learned counsel appearing on behalf of the opposite party no. 2 and Mr. Nityanand, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Jamalpur P.S. Case No. 160 of 2021 registered for the offence punishable under Sections 498-A, 504, 506, 34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.
3. Learned counsel appearing on behalf of the petitioner informs this Court that petitioner is ready to keep the opposite party no. 2, who is his legally wedded wife with full
Patna High Court CR. MISC. No.51973 of 2022(4) dt.24-04-2023 2/3 dignity and honour. He will also fulfill the physical as well as financial requirement of the opposite party no. 2. The petitioner has only one demand from opposite party no. 2 that she (opposite party no. 2) must reside along with him at the place of posting.

Mr. Tarkeshwar Prasad Verma, learned counsel appearing on behalf of the opposite party no. 2 informs this Court that opposite party no. 2 is also ready to live along with the petitioner subject to the condition that petitioner must support her with Rs. 10 lacs. He further informs that opposite party no. 2 will also request the State Government or the organization to transfer her at the place of posting of the petitioner.
5. Considering the mutual desire of the parties, the petitioner above named is directed to be provisionally released on pre-arrest bail subject to the condition that the petitioner and opposite party no. 2 must enter into a mutual agreement for which purpose the Court below must take serious steps so that the parties may reconcile their matrimonial dispute and live together happily and if it is found that no complaint is made by the either parties at least for a period of one year, the provisional bail granted to the petitioner must be made absolute on such
Patna High Court CR. MISC. No.51973 of 2022(4) dt.24-04-2023 3/3 terms and conditions as the Court below deem it fit and proper and the conditions as laid down under Section 438 (2) of the Cr.P.C.
6. The petitioner must discharge his obligation within a period of three weeks failing which, this order will automatically loose its force.
7. Accordingly, the present bail application disposed of.
