JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 353 and 307 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act and Section 3⁄4 of the Explosive Substance Act.
Taking into consideration that country made loaded Katta, bomb etc. were recovered from the conscious possession of the petitioner who does have criminal antecedent of three cases, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Khaira P.S. Case No. 34 of 2016 pending in the court of learned Chief Judicial Magistrate, Jamui stands rejected.
However, learned trial court is directed to expedite
Patna High Court Cr.Misc. No.27430 of 2016 (3) dt.06-09-2016 2/2 the trial of the petitioner and try to conclude the same as early as possible preferably within six months from the date of receipt/production of copy of this order. It is made clear that if the trial of the petitioner is not concluded within the above stated period, the petitioner may renew his prayer for bail before the learned court below itself.
