JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 498(A) of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

The allegation against the petitioner is of torturing the complainant for non fulfillment of demand of additional dowry. On behalf of the petitioner, it has been submitted that the petitioner has got no criminal antecedent. It is further submitted that there is no chance of reconciliation between the parties. It is also submitted that the petitioner is ready to deposit an amount of Rs. 4000/- (four thousand) per month in the court below, which may be released in favour of the complainant.

Patna High Court Cr.Misc. No.18519 of 2015 (5) dt.04-09-2015 2/2 On behalf of the State, it has been submitted that the petitioner is named in the complaint petition and he is the husband of the complainant.

Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 4000/- (four thousand) per month in the court below, which shall be released in favour of the complainant.

Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Banka in connection with Complaint Case No. 382 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
