13-07-2016 Heard Sri Uday Kumar, learned counsel for the petitioner. None appeared on behalf of State. The sole petitioner, who is in custody in Chhauradano P.S Case No. 10 of 2016 registered for the offence under Sections 399, 401, 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act, 1959, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner has falsely been arrested showing recovery of one country-made pistol. He submits that petitioner was having clean antecedent, however; after registering present case, the petitioner has been remanded in one another case also. According to learned counsel for the petitioner, the petitioner is in custody since 09-02-2016, which fact has been stated in paragraph - 9 of the

Patna High Court Cr.Misc. No.26853 of 2016 (2) dt.13-07-2016 2/2 petition.

In view of nature of accusation and period of custody, let the petitioner namely Shakti Kapoor be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Raxaul at Motihari, Distt. East Champaran in connection with Chhauradano P.S. Case No. 10 of 2016.
