JUSTICE BIRENDRA KUMAR ORAL ORDER 31-08-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 399,402 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act. Petitioner and some other co-accused were apprehended on suspicion that they were preparing to commit dacoity. From possession of the petitioner, a motorcycle was recovered, which the petitioner claims to be of his father.

Submission is that no incriminating article was recovered nor the petitioner has got any criminal antecedent. There is no material to substantiate that arrested persons and others were preparing to commit dacoity.

No.51065 of 2018 (2) dt.31-08-2018 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with K.Hat Police Station Case No.277 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
