Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The Petitioner seeks regular bail in connection with Sheikhopur Sarai P.S.Case No. 111 of 2017, registered for offences punishable under Sections 147, 148, 149, 323, 325, 307 IPC and later on Section 302 of the IPC has been added. Allegation against the petitioner is that the petitioner along with other accused persons as per F.I.R. is that they have assaulted the son of the informant, causing injury and he was taken to hospital and he died later on.
Submission of the learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and the parties are neighbors and the occurrence had taken place
Patna High Court Cr.Misc. No.52228 of 2018 (2) dt.04-10-2018 2/2 due to land dispute and other co-accused have been granted privilege of bail by different Co-ordinate Benches of this court vide order dated 14.12.2017, passed in Cr. Misc. No. 58039 of 2017, vide order dated 06.03.2018 passed in Cr. Misc. No. 2326 of 2018 and the petitioner is in custody since 24.07.2018. Heard learned A.P.P. as well as learned counsel for the informant opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Sheikhpura in connection with Sheikhpura Sarai P.S.Case No. 111 of 2017, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
