JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
It is alleged that the informant heard sound of window breaking and, consequently, saw this petitioner fleeing away. It was found that the petitioner took Rs. 5,000/- cash from the house of the informant.
It is submitted by learned counsel for the petitioner that petitioner is own nephew of the informant and in the background of land dispute the accusation has been levelled. For the occurrence of 13.01.2015, the F.I.R. was registered on 14.01.2015 but it reached to the court of learned Judicial Magistrate on 17.01.2015 which suggests antedating of F.I.R.

No.19664 of 2015 (2) dt.29-04-2015 2/2 Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Ghogha Kahalgaon P.S. Case No.27 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bond of the petitioner will be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that he will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
