JUSTICE HARISH KUMAR ORAL ORDER 19-12-2023 The petitioner claims to be son of the erstwhile employee, who superannuated from the post of Panchayat Sevak way back on 01.12.1992 and subsequently died on 24.09.2019, filed the present writ petition, seeking a direction upon the respondents to ensure the payment of due arrear of pension from November, 2018 to September, 2019 as well as, other monetary benefits, arising out of miscalculation in the pay scale found payable to his late father alongwith penal interest.

2. It is submitted on behalf of the Punjab National Bank that so far the arrears of pension for the afore-noted period is concerned, the same has already been paid to the petitioner on 30.12.2021 itself to the tune of Rs. 2,31,649/-.

Learned counsel for the State also referring to the statements made in the writ petition submits that so far the another grievance is concerned for which the father of the petitioner had already filed a writ petition bearing CWJC No. 3098 of 2008, which was disposed off by a Bench of this Court on 05.08.2014, directing the father of the petitioner to file a fresh application in detail with a copy of the order of the Hon'ble Court and in turn the District Magistrate, Aurangabad was under obligation to get the matter verified and pass appropriate order in this regard. He thus submits that since there is already a direction of this Court, no further order is required.

4. Considering the submissions advanced and the averments made in the writ petition as well as counter affidavit, the present writ petition stands disposed off.

5. However, needless to observe that in case the application filed on behalf of the father of the petitioner has not been disposed off till date with regard to the miscalculation in the pay scale to which the father of the petitioner was entitled to by virtue of the second bound promotion, the same may be disposed off, if not done till date.
