The petitioner is languishing in custody for the offences punishable under Sections 328/120B of the Indian Penal Code and Sections 30(a)/30(c)/30(d) of the Bihar Prohibition and Excise Act, 2016.
From the riverside liquor as well as the materials to be used for preparation of liquor and utensils were recovered. Allegation is that the same is of the petitioner and others. The petitioner has stated on oath that he has got no criminal antecedent.
Considering the aforesaid fact, let the petitioner,
Patna High Court CR. MISC. No.49663 of 2019(2) dt.09-08-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No.5373 of 2019, arising out of Bakhtiyarpur P.S. Case No.193 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
