2. The petitioners have prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307 and 302 of the Indian Penal Code.
3. As per the prosecution story, upon hearing the decision of the Punches regarding partition of ancestral land, the petitioners and other F.I.R. named co-accused persons assaulted the informant and his father with deadly weapons, due to which, father of informant died. From perusal of paragraph - 3 of the petition, it appears that petitioners are accused in one more case.
4. It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.58715 of 2024(4) dt.06-12-2024 2/2 that petitioners have been falsely implicated in this case. Present case is a counter version of Raghopur P.S. Case No. 102 of 2022 filed by the petitioners' side. No specific allegation is attributed to the petitioners and the allegations are general and omnibus in nature. Members of both parties has sustained injuries. Petitioners are languishing in judicial custody since 22.06.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Vaishali Hajipur in connection with Raghopur P.S. Case No. 101 of 2022.
