Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner seeks bail in a case registered under Section 399/402 of the Indian Penal Code and Sections-25 (1b)a, 26/35 of the Arms Act. The accused persons along with the petitioner are said to have been planning for committing dacoity. On the tip off, the informant along with police personnel reached at the place of occurrence and caught two persons including the petitioner. Other miscreants are said to have fled away.

It has been submitted on behalf of the petitioner that the

Patna High Court CR. MISC. No.51975 of 2022(2) dt.16-12-2022 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 18-06-2022 and charge sheet has been submitted in the present case. One country-made pistol along with one live cartridge was recovered from possession of the petitioner. There is no compliance of Section-100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Mohania, Kaimur in connection with Kudra P.S. Case No. 160 of 2022.
