JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 05.09.2017 passed in Cr. Misc. No. 33579 of 2017 in connection with Sarai Ranjan P.S. Case No. 187 of 2016 and petitioner is husband of the deceased and allegation is of causing dowry death of the deceased.
Submission of learned counsel for the petitioner that the deceased died due to diarrhea and as the informant was pressing the petitioner for execution of gift deed in favour of son of the petitioner and when petitioner did not agree, he came with this false case, which will appear from the fact that there is delay of three months in lodging the F.I.R and petitioner has been in judicial custody 02.03.2017.

Patna High Court Cr.Misc. No.55236 of 2018 (2) dt.05-09-2018 2/2 Having heard both sides, considering the facts and circumstances of the case and nature of accusation and further the prayer for bail of the petitioner has already been dismissed on merit. I am not inclined to enlarge the petitioner on bail. This application is accordingly dismissed.
However, since the petitioner has been in custody since long, the trial court is directed to expedite and conclude the trial as early as possible.
