In the instant petition, the petitioner has prayed for the following reliefs:
"For issuance of an appropriate writ(s), order(s) direction(s) to the respondents to make the payments of monthly salary to the petitioner who has been discharging his duty to the post of Panchayat Secretary under the control of Respondent no.4 without a single penny since 18.2.2010 to till date and
Patna High Court CWJC No.3380 of 2021(3) dt.08-02-2022 2/2 further to make the entire arrears along with monthly salary to the petitioner with 10% per annum interest." The present petition is not maintainable under Article 226 of the Constitution. In view of section 19 of Administrative Tribunal Act, 1985 read with Apex Court decision in the case of Sampat Kumar Vs. the Union of India and L. Chandra Kumar Vs. Union of India & Ors. reported in (1997) 3 SCC 261, the writ petition stands disposed of as not maintainable with liberty to the petitioner to approach the Central Administrative Tribunal by filing appropriate petition. The Central Administrative Tribunal is hereby directed to take note of Section 14 of the Limitation Act for the purpose of entertaining the application for condonation of delay in presenting application. With the above observation, the present petition stands disposed of.
