2. The petitioner is apprehending his arrest in Areraj P.S. Case No. 13 of 2024 registered under Sections 399, 402 of the Indian Penal Code and 25(1-b)a/26/35 of the Arms Act.
3. Allegedly, on the tip off, the informant along with police personnel raided the place of occurrence and apprehended one person namely Manu Malik from whose possession, one country-made pistol alongwith two live cartridges have been recovered.
4. It has been submitted on behalf of the petitioner that the co-accused Manu Malik was arrested at the spot and from his possession, one country-made pistol alongwith two live
Patna High Court CR. MISC. No.57539 of 2024(3) dt.20-09-2024 2/2 cartridges have been recovered and he has named the petitioner. Except that, there is nothing against the petitioner. The petitioner is a person of clean antecedent.
5. Learned APP has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, East Champaran, Motihari in connection with Areraj P.S. Case No. 13 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
